1. Introduction and Acceptance of Terms

Welcome to Claripath, a career exploration, guidance, assessment, and mentorship platform operated by BeatsAndBytes Apps ("BeatsAndBytes," "Claripath," "we," "us," or "our").

These Terms & Conditions ("Terms") govern your access to and use of the Claripath mobile application, website, and related services (collectively, the "Services").

By accessing, downloading, installing, registering for, or using the Services, you agree to be bound by these Terms, our Privacy Policy, and any other policies or guidelines that we make available through the Services.

The Services may cover career and educational pathways across areas including, but not limited to:

• Information Technology and technology-related fields;

• Other academic, vocational, and professional pathways.

Claripath may add, modify, suspend, or discontinue features from time to time.

Claripath does not guarantee that AI-generated content or recommendations will always be accurate, current, unbiased, or error-free.

Where Claripath uses third-party AI technologies, the processing of information through those technologies is also subject to the applicable terms and privacy practices of those providers.

6. User Accounts and Registration

9. Mentor Accounts

Individuals who wish to provide mentoring services may register as Mentors.

Mentors may be required to provide information relating to:

• Identity;
• Education;
• Professional experience;
• Qualifications;
• Skills;
• Areas of expertise;
• Professional profiles;
• Other information reasonably necessary for verification.

Claripath may conduct identity, credential, professional experience, or other verification checks before approving or continuing a Mentor account.

Verification does not constitute a guarantee, certification, endorsement, or warranty of a Mentor's qualifications, character, conduct, or advice.

Claripath may approve, reject, suspend, or remove Mentor profiles at its discretion, subject to applicable law.

10. Mentor Responsibilities

Mentors agree to:

• Provide truthful and accurate information about their background and experience;
• Provide guidance in a professional and respectful manner;
• Maintain appropriate professional boundaries;
• Respect the privacy of students;
• Avoid requesting unnecessary personal information;
• Avoid discriminatory, abusive, threatening, or inappropriate conduct;
• Avoid exploiting or manipulating students;
• Not engage in sexual or romantic conduct with student users;
• Not use Claripath to solicit students for unauthorised services;
• Not attempt to circumvent Claripath's payment or platform systems;
• Not misuse student information;
• Follow all applicable Claripath policies.

Mentors must not represent themselves as employees, agents, or official representatives of Claripath unless expressly authorised in writing.

Mentors are responsible for the professional opinions and guidance they provide.

11. Student–Mentor Safety

Users must not use the platform to:

• Harass, threaten, bully, exploit, or abuse another user;
• Request inappropriate personal information from minors;
• Engage in sexual or romantic interactions with minors;
• Encourage minors to conceal communications from parents or guardians;
• Pressure students into financial transactions;
• Request or offer inappropriate photographs or personal content;
• Attempt to move interactions outside the platform for improper purposes;
• Arrange unsafe or inappropriate offline meetings;
• Engage in grooming or exploitative behaviour.

Claripath may investigate reports of misconduct and may take appropriate action, including:

• Removing content;
• Restricting communications;
• Suspending accounts;
• Permanently terminating accounts;
• Reporting conduct to appropriate authorities where required or appropriate.

Users should immediately report suspected abuse, exploitation, harassment, or other safety concerns through the designated reporting or support channels.

12. Mentoring Services

Claripath may facilitate connections between students and Mentors.

Claripath may provide tools to assist with:

• Mentor discovery;
• Mentor matching;
• Session scheduling;
• Payments;
• Communication;
• Reviews or feedback.

Claripath does not guarantee that a particular Mentor will be available or suitable for every user.

Mentor opinions, recommendations, and guidance are the responsibility of the individual Mentor and do not necessarily represent the views of Claripath or BeatsAndBytes Apps.

Users should exercise their own judgment when selecting and interacting with Mentors.

13. Community Features

Where Claripath provides community forums, discussion boards, comments, or other user-generated content features, users must comply with these Terms and applicable Community Guidelines.

Users must not post or share:

• Illegal content;
• Threats or harassment;
• Hate speech;
• Sexually explicit content;
• Content that exploits or sexualises minors;
• Personal information belonging to others without permission;
• Fraudulent or misleading information;
• Spam;
• Unauthorised advertising;
• Malicious software;
• Content that infringes intellectual property rights.

We may remove, restrict, or moderate content that violates these Terms or applicable policies.

We may suspend or terminate accounts responsible for serious or repeated violations.

14. User-Generated Content

Users may be permitted to submit content such as:

• Forum posts;
• Reviews;
• Comments;
• Questions;
• Feedback;
• Profile information.

You retain ownership of content that you lawfully own.

By submitting content to Claripath, you grant us a non-exclusive, worldwide, royalty-free licence to host, store, reproduce, display, and distribute that content as reasonably necessary to operate, provide, maintain, and improve the Services.

This licence does not transfer ownership of your content to Claripath.

You represent that:

• You have the necessary rights to submit the content;
• The content does not violate the rights of another person;
• The content does not violate applicable law;
• The content does not contain unnecessary sensitive personal information.

We may remove content that violates these Terms or applicable law.

15. Prohibited Activities

You agree not to:

• Use the Services for unlawful purposes;

• Create accounts for fraudulent purposes;
• Access another user's account without permission;
• Harass or abuse users, Mentors, employees, or representatives;
• Attempt to bypass platform security;
• Reverse engineer or decompile the Services except where permitted by law;
• Introduce malware, viruses, or harmful code;
• Use bots or automated systems without permission;
• Scrape or systematically extract platform data;
• Circumvent payment systems;
• Attempt to obtain paid Services without payment;
• Use the platform to advertise unauthorised products or services;
• Collect information about minors for unauthorised purposes;
• Use Claripath to solicit students outside authorised mentoring relationships;
• Engage in fraudulent, deceptive, or abusive conduct.

Violation of these Terms may result in suspension or termination of access.

16. Payments and Billing

Certain Claripath Services may require payment.

Prices, fees, taxes, and applicable charges will be displayed before you complete a purchase.

Unless otherwise stated:

• Prices are displayed in Indian Rupees (INR);
• Applicable taxes may be included or added as required by law;
• You are responsible for charges authorised through your account;
• Prices may change for future purchases or renewals.

Where a subscription is offered, the applicable subscription terms, renewal frequency, cancellation procedure, and price will be disclosed before purchase.

17. Payment Processing

Payments may be processed using third-party payment providers, including Razorpay or other providers we may use.

By completing a payment, you agree to comply with the applicable payment provider's terms.

Claripath may receive transaction-related information necessary to confirm and administer payments.

We do not generally store full payment card credentials on our own servers.

Payment processing may be subject to the terms, policies, and technical availability of the relevant payment provider.

18. Refunds and Cancellations

Refunds and cancellations are governed by our applicable Refund and Cancellation Policy, which forms part of these Terms.

Subject to applicable law and the specific service purchased:

• Refund eligibility may differ between subscriptions, assessments, consultations, and mentoring sessions;
• Refunds may be available for failed or undelivered Services;
• Cancellation deadlines may apply to scheduled Mentor sessions;
• Certain Services may be non-refundable once delivered or substantially used.

Where a refund is approved, it will generally be processed using the original payment method or another method permitted by the relevant payment provider.

Nothing in these Terms excludes any refund or consumer right that cannot lawfully be excluded.

19. Mentor Payments

Where Mentors provide paid services through Claripath, payment collection and Mentor payouts may be governed by a separate Mentor Agreement.

The Mentor Agreement may specify:

• Mentor fees;
• Platform commissions;
• Taxes;
• Payout schedules;
• Refund adjustments;
• Cancellation rules;
• Payment processing arrangements.

Mentors are responsible for complying with applicable tax and legal obligations relating to their earnings.

20. Intellectual Property

All intellectual property rights in the Services and Claripath-owned materials belong to BeatsAndBytes Apps or its licensors, including:

• Software;
• Application design;
• Website design;
• Text;
• Graphics;
• Logos;
• Branding;
• Icons;
• Assessments;
• Career roadmaps;
• Original educational content;
• Databases;
• Trademarks.

Except as expressly permitted by these Terms, you may not copy, reproduce, modify, distribute, sell, lease, reverse engineer, or create derivative works from Claripath-owned content without prior written permission.

"Claripath" and associated branding may be trademarks or trade names of BeatsAndBytes Apps or its licensors.

21. Third-Party Services and Links

The Services may contain links to third-party websites, applications, educational institutions, payment providers, or other services.

Third-party services are not controlled by Claripath.

We are not responsible for:

• Third-party content;
• Third-party privacy practices;
• Third-party availability;
• Third-party products or services;
• Third-party transactions.

Users should review the terms and privacy policies of third-party services before using them.

22. Service Availability

We aim to provide reliable Services but do not guarantee that the Services will always be available, uninterrupted, error-free, secure, free from bugs, or compatible with every device.

Nothing in these Terms excludes warranties or rights that cannot legally be excluded under applicable law.

24. Limitation of Liability

To the maximum extent permitted by applicable law, BeatsAndBytes Apps and Claripath will not be liable for indirect, incidental, special, consequential, or punitive damages arising from or relating to your use of the Services.

This may include losses arising from:

• Reliance on career recommendations;
• Reliance on Mentor advice;
• Changes to educational or career information;
• Third-party services;
• Service interruptions;
• Loss of data;
• Unauthorised activity not caused by our failure to maintain reasonable security measures.

To the maximum extent permitted by applicable law, our aggregate liability for claims arising directly from the Services will not exceed the amount you paid to Claripath for the relevant Services during the twelve months preceding the event giving rise to the claim.

Nothing in these Terms limits or excludes liability that cannot lawfully be limited or excluded, including liability arising from fraud, wilful misconduct, or other matters for which exclusion is prohibited by applicable law.

25. Indemnification

To the extent permitted by applicable law, you agree to indemnify and hold harmless BeatsAndBytes Apps, Claripath, and their respective officers, employees, contractors, and representatives from claims, losses, liabilities, damages, and reasonable expenses arising from:

• Your violation of these Terms;
• Your unlawful use of the Services;
• Your violation of another person's rights;
• Content you submit;
• Fraudulent or abusive activity conducted through your account.

This provision does not apply to the extent that a claim results from our own unlawful conduct, negligence, or matters that cannot legally be excluded.

26. Account Suspension and Termination

You may stop using the Services at any time.

Where available, you may request account deletion through the App or by contacting support.

We may suspend or terminate an account where reasonably necessary because of:

• Serious or repeated violations of these Terms;
• Fraudulent activity;
• Abuse or harassment;
• Threats to student safety;
• Misuse of the platform;
• Illegal activity;
• Security concerns;
• Legal or regulatory requirements.

Where reasonably practicable, we may provide notice before termination, except where immediate action is necessary to protect users, the platform, or comply with legal requirements.

Termination does not automatically entitle a user to a refund unless required by applicable law or our Refund and Cancellation Policy.

Our Privacy Policy governs the retention and deletion of personal information following account termination.

27. Emergency and Safety Reporting

If you become aware of suspected child abuse, exploitation, harassment, or serious misconduct occurring through the Services, report it to Claripath immediately through our designated support or reporting channels.

Where required by law, we may report suspected illegal activity to appropriate authorities.

28. Governing Law and Dispute Resolution

These Terms are governed by the laws of India, subject to applicable consumer protection and other mandatory legal rights.

If the dispute cannot be resolved through good-faith discussions, either party may pursue remedies available under applicable law.

Subject to applicable law, disputes may be brought before the courts having appropriate jurisdiction in India.

Nothing in this section limits any mandatory rights available to consumers or users under applicable law.

29. Changes to These Terms

We may update these Terms from time to time.

When we make material changes, we may:

• Publish the revised Terms;
• Notify users through the App;
• Send an email or other appropriate notification.

Where applicable law requires additional consent, we will obtain it.

These Terms, together with the Privacy Policy, Refund and Cancellation Policy, Student and Mentor Safety Policy, Community Guidelines, and any applicable additional agreements, constitute the agreement between you and BeatsAndBytes Apps regarding your use of the Services.

Where a separate agreement applies to a specific service or relationship, such as a Mentor Agreement, that agreement will govern the relevant subject matter to the extent of any conflict.
